WRITING TESTS

EASY TO STAY LIVING WHEN YOU GO AWAY.

BY EMILIA RADOW INGVARSON

Writing a will means that you have to decide how you want your assets to be distributed when you have passed away. Everything except the breasts of the breast wing can be willed away to exactly who or what you want, for example if it is a charity you want to donate part of your assets to. But in order for the will to be valid, it is important that all formal requirements are met.

WHEN CAN YOU WRITE YOUR TESTAMENT?

You can make your will from the day you turned 18. Even unauthorized persons are allowed to draw up wills, but this only applies to income received by the unauthorized person through their own work.
It is important to keep in mind that over time, you will update your will according to how your life, family situation, assets, etc., develop and change.

MUST BE PROVIDED TO BE VALID

In order for a will to be valid, it must be witnessed. The will must be drawn up in writing and the signatures must be witnessed by two unrelenting testament witnesses present at the same time. The witnesses should know that there are signatures regarding a will they testify but do not need to be aware of the contents of the will.

CORRECT DESIGN

When designing your will, it is important to know the difference between “free disposal” and “full ownership”. If someone inherits a free right of inheritance, then the heir can do what he and she wants with the property, except to bequeath it. If you instead inherit wills with full ownership or do not write any regulations at all, the heir also has the right to bequeath property, with the exception of children’s legal plots. Consult a legally knowledgeable person regarding the formulations so that the will is properly formulated and as desired.

It is also good to write down in a separate document thoughts, wishes and ideas about important decisions that must be made by survivors after your departure. Decide on, for example, your funeral, tombstone, memorial grove, organ donation, etc.

TIPS WHEN YOU WILL WRITE A TESTAMENT

  • Please tell adult children how you thought about asset allocation. It can avoid later issues and disputes.
  • Find out how a will is designed to be valid. You can create one yourself.
  • Place the will where it is possible to find or tell the concerned where it is located.
  • Periodically review your will so that the content matches your wishes. Source: lansforsakringar.se
